Bylaw 9285 (September 26, 1989)
To provide a Site Specific Development Control District to accommodate 16 town homes with a Victorian theme that will be compatible with the surrounding low density residential neighbourhood.
This district shall apply to Lots 23 to 26, Block 2, Plan 882 1068; located on the north side of University Avenue and west of 111 Street, Garneau, River Lot 7.

a. | The general site layout shall be in accordance with the site plan as illustrated in Appendix I to this District Schedule. |
b. | The maximum number of dwellings allowed in this District shall be four. |
c. | The minimum site area shall be 190 m2 (2,044 sq. ft.) for each row housing dwelling. |
d. | The minimum site width shall be 5.6 m (18.3 ft.) for each row house dwelling. |
e. | The minimum site depth shall be 30 m (98.4 ft.). |
f. | The maximum height shall not exceed 10.5 m (34.4 ft.) except that in case of architectural features such as steeples, the maximum height shall not exceed over 14.2 m (46.5 ft.). |
g. | The overall maximum total site coverage shall not exceed 40% with a maximum of 25% for principle buildings and a maximum of 13% for accessory buildings. The Development Officer may increase the maximum to 46% if the increase is for amenity areas. |
h. | The minimum front yard shall be 4.5 m (14.7 ft.), with setback variations to the facade of the buildings of up to 0.6 m (2 ft.). |
i. | The minimum rear years shall be 7.5 m (24.6 ft.). |
j. | A minimum side yard on the west boundary of the site illustrated in Appendix I, shall be 1.2 m (4.0 ft.) in width. |
k. | A minimum side yard of 4.5 m (14.8 ft.) shall be provided on the east side of the site. |
l. | Stair and deck projections into the required yards may be allowed at the discretion of the Development Officer, if in his opinion, the projections would be in keeping with the overall design of the buildings. |
m. | A maintenance easement shall be granted by the owner of adjacent lots between the most easterly two lots. The easement shall be registered by caveat against the title of the lots involved. |
n. | Two parking spaces shall be provided for each dwelling unit in this District. |
o. | Where the vehicle doors of the detached garage face the lane abutting the site, no portion of the garage shall be located less than 3 m (9.8 ft.) from the lane. |
p. | Where the vehicle doors of the detached garage face the flanking public roadway (111 Street), the distance between the garage and the flanking roadway shall not be less than 4.5 m (14.8 ft.). |
q. | The exterior design of the building shall incorporate architectural elements of the Victorian style as illustrated in Appendix II to this District Schedule. |
r. | Signs shall be allowed in this District as provided for in Schedule 79.A and in accordance with the general provisions of Sections 79.1 to 79.9 inclusive of the Land Use Bylaw. |
s. | Offices-in-the-home shall be developed in accordance with Section 84 of the Land Use Bylaw. |
t. | Homecrafts shall be developed in accordance with Section 85 of the Land Use Bylaw. |
u. | Development in the District shall be evaluated with respect to compliance with the General Development Regulation of Sections 50 to 79 inclusive of the Land Use Bylaw. |
v. | The Development Officer may grant relaxations to Sections 50 to 79 of the Land Use Bylaw and the provisions of this District if, in his opinion, such a variance would be in keeping with the general purpose of this District and would not affect the amenities and enjoyment of neighbouring properties. |
