Keheewin - southeast corner of the intersection of 23 Avenue and 109 Street

Bylaw 7400 (November 15, 1983)

To establish a site specific direct control district for a shopping centre such that, by limiting the range of specific land uses and establishing sensitive site development regulations, the negative traffic, noise and visual impacts on nearby residential properties located east and south of the site are minimized.

This DC5 District shall apply to Lot 51, Block 2, Registered Plan 812 0954, located on the southeast corner of the intersection of 23 Avenue and 109 Street, Keheewin, Yellowbird

The following regulations shall apply to all uses:
a. The maximum floor area ratio shall be 0.7.
b. A landscaped yard, a minimum of 4.5 m (14.76 ft.) in width shall be provided along the east and south property lines of the site.
c. A landscaped yard, a minimum of 4.5 m (14.76 ft.) in width shall be provided along the west and north property lines of the site, except that if no vehicular access is provided to the site across such property lines, then the minimum landscaped yard shall be not less than 3.0 m (9.84 ft.).
d. The principal building(s) shall be sited such that no parking, loading, storage, trash collection, outdoor service or display areas are located between the building(s) and the required yards along the south and east property lines of the site.
e. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a required yard, and loading, storage, parking and trash collection areas shall be screened from view from any adjacent sites and public roadways in accordance with the provisions of Section 69.3 of the Land Use Bylaw.
f. The maximum building height shall not exceed 10 m (32.8 ft.) nor two storeys, except that the maximum height for the portion of the building adjacent to the required yards along the south and east property lines shall not exceed 4 m (13.1 ft.) nor one storey. The maximum building height shall be measured as the vertical distance between grade and the highest point of the roof. The transition from the two storey portion of the building to the one storey portion of the building shall be achieved through the use of a sloping roof not exceeding a maximum pitch of 1 to 3 (0.3 m, 1 ft.) vertical for every 1.2 m (3 ft.) horizontal). The roof shall be finished with materials consistent with architectural character of the surrounding residential development. The design of the roof may include such features as dormers or gables to enhance the residential character of the roof, provided that the highest point of such features does not extend more than 1.5 m (4.9 ft.) above the maximum building height, that the width of a dormer or gable does not exceed 9 m (29.4 ft.), and that any windows included in such features do not adversely affect the privacy of the residential development to the east and south of the site.
g. Development shall be in accordance with the following architectural guidelines, to the satisfaction of the development officer:
 
i. all exterior finishing materials must be of good quality, durable and attractive in appearance. Acceptable materials include, but are not limited to, either separately or in any combination, brick, cedar or splitstone concrete;
ii. all mechanical equipment on the roof of any portion of any building on the site shall be completely screened or incorporated within the building roof; and
iii. no signs, antennae or objects of any other similar nature on any portion of any building shall be visible to a resident from the habitable ground floor area of any residential unit to the east or south.
h. To ensure that a high standard of appearance and a sensitive transition to the surrounding residential properties are achieved, detailed landscaping plans shall be submitted with the initial development permit application for approval by the Development Officer in consultation with the Parks and Recreation Department. In addition to the requirements of Section 69 of the Land Use Bylaw, extensive plantings of mature trees and shrubs shall be used to substantially screen or obscure the development from the residential districts located east and south of the site.
i. Vehicular access shall be restricted to 23 Avenue and 109 Street.
j. Developments in this district shall be evaluated with respect to compliance with the General Development Regulations of Sections 59 to 79 inclusive, of the Land Use Bylaw.
k. Vehicular-oriented Uses shall be developed in accordance with Section 82 of the Land Use Bylaw.
l. Daytime Child Care Services shall be developed in accordance with Section 93 of the Land Use Bylaw.
m. Signs shall be allowed in this district as provided for in Schedule 79D and in accordance with the general provisions of Section 79.1 to 79.9 inclusive, of the Land Use Bylaw.
a. The seating capacity of minor and major eating and drinking establishments shall be limited to 200 persons, except that the seating capacity of facilities primarily intended for the provision and consumption of alcoholic beverages or the provision of theatre, dancing or cabaret entertainment shall be limited to 100 persons.
