Bylaw 10571 (January 17, 1994)

To establish a Site Specific Development Control District to accommodate low to medium density residential development consisting of semi-detached housing and row housing and to establish sensitive site development regulations to ensure that development will be compatible with the surrounding residential land uses.

This District shall apply to a 1.07 ha portion of SE 29-51-24-W4 as shown on the map entitled "Schedule C Map", which map is attached to and forms part of this Bylaw, Blackburne.

a. Semi-detached Housing, Row Housing and Linked Housing
b. Minor Home Occupations
c. Major Home Occupations
d. Residential Sales Centre
a. The maximum total site density shall not exceed 28 units/hectare.
b. The maximum height shall not exceed 10 m (32.8 ft.) nor 2½ storeys with the exception that buildings along the north portion of the site abutting the RF1 District shall not exceed 4.5 m nor 1½ storeys.
c. The minimum site area shall be 240 m2 (2,583 sq. ft.) for each dwelling unit.
d. The minimum site width shall be 8 m (26.2 ft.) for each dwelling unit.
e. The minimum site depth shall be 30 m (98.4 ft.).
f. The maximum total site coverage shall not exceed 40 percent with a maximum of 12 percent for garages or car ports. Garages or car ports shall be designed as an integral part of the principal building.
g. Landscaped yards will be provided as follows:
 
i. a landscaped yard, a minimum of 4.5 m (14.7 ft.) in width, shall be provided adjacent to the north property line where the site abuts the RF1 District and 6.0 m where the site abuts public roadways;
ii. a landscaped yard, a minimum of 6.0 m (19.7 ft.) in width, shall be provided adjacent to the west and east property lines and adjacent to private roadways; and
iii. a landscaped yard, a minimum of 4.5 m (14.8 ft.) in width, shall be provided adjacent to the south property line. Where a development flanks the south property line with no Habitable Room Window oriented to the south, this minimum yard may be reduced to 3.0 m (9.8 ft).
h. Screen fencing shall be provided as follows:
 
i. A 1.8 m (5.9 ft.) high solid screen fence shall be installed on private property along the north property line adjacent to the RF1 District;
ii. any screen fence located in the yard adjacent to the public roadway shall be set back a minimum of 3.0 m (9.8 ft.) and will be of a design complementary to the design of the principal buildings; and
iii. a 1.8 m (5.9 ft.) high solid screen fence shall be installed on private property adjacent to the east property line where the site abuts Calgary Trail Southbound.
i. Landscaping for the balance of the site shall consist of a mixture of deciduous and coniferous trees. Two trees per dwelling unit will be provided together with five shrubs to the satisfaction of the Development Officer.
j. A Private Outdoor Amenity Area, at grade, a minimum of 30 m2 (322.9 sq. ft.) per dwelling unit shall be provided.
k. Separation Space shall be provided between two or more dwellings in accordance with Section 58 of the Land Use Bylaw.
l. The Development Officer shall require, as a condition of approval, that the applicant provide an irrevocable letter of credit, in the amount of 100% of the estimated landscaping costs, the conditions of security being that:
 
i. if the landscaping is not completed in accordance with the approved landscape plan within one (1) growing season after completion of the development, then the amount fixed shall be paid to the city for its use absolutely; and
ii. the Development Officer shall not release the letter of credit until an inspection of the site has determined that the landscaping has been installed, well maintained and is in a healthy condition one (1) growing season after completion of the landscaping.
m. To ensure that a high standard appearance and a sensitive transition to the surrounding land uses are achieved, detailed landscaping plans shall be submitted with the initial development permit application for approval by the Development Officer, which in the opinion of the Development Officer, comply with the landscaping requirements specified by Clauses g,h,i and j of this District.
n. Development on the site will comply with the recommendations of the EBA Engineering Report on Blackburne (Amendment No. 1).
o. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a required yard. Loading, storage and trash collection areas shall be screened from view from adjacent public roadways in accordance with Section 69.3 of the Land Use Bylaw. Trash collection facilities shall make provisions for recycling initiatives.
p. Signs may be allowed in this District in accordance with Schedule 79A and the general provisions of Sections 79.1 to 79.9, inclusive, of the Land Use Bylaw.
q. Development in this District shall be evaluated with respect to compliance with the General Development Regulations of Sections 50 to 79 inclusive, of the Land Use Bylaw, except that in addition to the requirements of Section 55 of the Land Use Bylaw restricting parking in residential areas, no recreational vehicles shall be stored on the site except in an area designated for such vehicles which is properly screened and landscaped.
r. The Development Officer may grant relaxations to Section 50 to 79 of the Land Use Bylaw and the provisions of this District if, in his opinion, such a variance would be in keeping with the general purpose of this District and would not affect the amenities, use and enjoyment of neighbouring properties.
a. Minor Home Occupations shall be developed in accordance with Section 84 of the Land Use Bylaw.
b. Major Home Occupations shall be developed in accordance with Section 85 of the Land Use Bylaw.
c. Residential Sales Centres shall be developed in accordance with Section 95 of the Land Use Bylaw.

Bylaw attachments
