Bylaw 14098 (September 29, 2005)

To provide for the development of low rise apartment housing with restrictions to density and parking ratios to reduce the impact on adjacent low density residential development, in conformance with the requirements of the Leger NASP.

This Provision shall apply to a portion of SE 1/4 2-52-25; containing approximately 0.55 ha, more or less, as shown on Schedule ”A” of the Bylaw adopting this Provision.

a. Development on this site shall be in accordance with the following regulations and within the building envelope as illustrated in Appendix I of this Bylaw.
b. The maximum number of dwellings shall be 60 units.
c. The maximum Height shall not exceed 14.0 m nor 4 Storeys. Floor Area may be developed in attic areas as additional space to a Dwelling, and not counted as a Storey, provided the additional Floor Area creates architectural interest to the design of the building and the development is within the maximum allowable Height. The addition of dormers or other windows will be reviewed subject to the satisfaction of the Development Officer.
d. The maximum Floor Area Ratio shall be 1.3. The maximum Floor Area Ratio may be increased to 1.4 when underground parking is provided.
e. The minimum Front Yard shall be 6.0 m.
f. The minimum Rear Yard shall be 7.5 m.
g. The minimum Side Yard shall be 1.0 m for each Storey or partial Storey, except that a total of at least 2.0 m shall be provided in all cases..
h. To ensure a high standard of appearance for the site and a sensitive transition to the surrounding land uses, detailed landscaping plans shall be submitted to the Development Officer at the time of application for the Development Permit. Such plans shall identify all landscaping materials, including trees, shrubs, screening elements and exterior lighting for the landscaped yards, amenity areas and adjacent roadways.
i. Separation Space shall be provided in accordance with Section 48 of this Bylaw.
j. A minimum Amenity Area of 7.5 m2 per Dwelling shall be provided.
k. Notwithstanding the other regulations of this Provision, where Apartment Housing abuts a Site zoned to allow Single Detached Housing as a Permitted Use, the following regulations shall apply:
 
i. a minimum landscaped Setback of 7.5 m shall be required from any property line in common with Single Detached Housing.
ii. no outdoor parking, trash collection or outdoor storage areas shall be developed within 7.5m of any property line that abuts a Site zoned to allow Single Detached Housing as a Permitted Use. Loading, trash collection and service areas shall be located, constructed and screened to the satisfaction of the Development Officer.
iii. a solid screen fence, 1.83 m in height, shall be installed along the east, south and west property lines of the site, as shown on Appendix I.
iv. design techniques including, but not limited to, the use of sloped roofs, variations in building setbacks and articulation of building façades, shall be employed in order to minimize the perception of massing of the building when viewed from adjacent residential areas and roadways;
v. building finishes shall be of high quality, durable and attractive in appearance, and compatible with the exterior finishing materials and colours typical of adjacent Single Detached Housing; and
vi. where Apartment Housing is to be developed directly adjacent to a Site zoned to allow Single Detached Housing, the maximum Building Height for the directly adjacent façade of such Apartment Housing shall not exceed 10.0 m nor 2 1/2 Storeys, except that such directly adjacent Apartment Housing may exceed this Height, to a maximum of 14.0 m or four Storeys, provided that the portion of the building above 10.0 m or 2 1/2 Storeys is set back or stepped back from the façade so that the adjacent Single Detached Housing shall not be adversely impacted by excessive building massing or sun/shadow.
l. Underground parking shall be developed for the site in accordance with CPTED principles at a minimum ratio of 1.50 stalls per unit. Visitor parking shall be located at the surface, visible from the main entrance to the development.
m. Signs shall comply with the regulations found in Schedule 59B.
