Greenview - northwest corner of 40 Avenue and 50 Street

Bylaw 8196 (May 13, 1986)

To provide a Site Specific Development Control District to accommodate neighbourhood convenience commercial and personal service uses which are intended to serve the day to day needs of the residents of Woodvale and to establish sensitive site development regulations that will ensure compatibility with surrounding residential land uses, particularly by providing a residential appearance along 40 Avenue, and providing adequate separation on the west property line.

This DC5 District shall apply to a portion of Lot 1, Block 1, Plan 772 1465 (proposed Lot 1A, Block 1); located on the northwest corner of 40 Avenue and 50 Street, Greenview, Mill Woods.

a. The maximum floor area ratio shall be 0.40.
b. The maximum building height shall not exceed 5.5 m (18.0 ft.) nor one storey.
c. A minimum yard of 3 m (9.8 ft.) in width, shall be provided adjacent to the west boundary of the site. Within this yard, continuous cedar screen fencing of a solid and durable design, a minimum of 1.8 m (6.0 ft.) in height shall be provided along the west property line, together with a berm of 0.61 m (2.0 ft.), which shall be centered on the western property line. This yard may be hardsurfaced, except that mature deciduous trees, a minimum caliper of 5.5 cm (2.2 in) are to be provided to the satisfaction of the Development Officer, at a minimum interval of one tree for every 6.1 metres of linear yard (20 ft. of linear yard) and adjacent to the western property line.
d. The landscaped yard, berming and fencing shall be provided concurrent with the first stage of development on the site.
e. A minimum landscaped yard of 3 m (9.8 ft.) in width, shall be provided adjacent to 50 Street and adjacent to the northern boundary of the site.
f. A minimum landscaped yard of 6 m (19.7 ft.) in width, shall be provided adjacent to 40 Avenue, except that the Development Officer may allow a portion of this yard to be reduced to 3.6 m (11.8 ft.) in order to accommodate a corner encroachment of a proposed commercial building, which is to be located adjacent to 40 Avenue, at a maximum of 20.1 m (65.9 ft.) west of 50 Street. The side of the building encroaching into the yard shall include sloped roof treatment in order to provide a residential appearance along 40 Avenue. Within this yard, a 0.61 m (2.0 ft.) berm shall be provided together with landscaping consisting of mature evergreen and deciduous trees, to be provided at a minimum interval of one tree for every 4.6 metres of linear yard (15 ft. of linear yard).
g. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a required yard. Loading, storage and trash collection areas shall be screened from view from any adjacent sites and public roadways in accordance with the provisions of Section 69.3 of the Land Use Bylaw.
h. The maximum gross floor area of any individual business premise shall not exceed 275 m2 (2,960.07 sq. ft.), except that the Development Officer may allow an individual business premise to have a gross floor maximum of 465 m2 (5,005 sq. ft.) where, in his opinion the proposed business is primarily intended to serve residents of the neighbourhood and would not attract clientele from the district at large, and where, in his opinion and on the advice of the City Engineer such a development would not affect traffic circulation on the site or the functioning of adjacent roadways.
 
i. Development in this District shall comply with the following architectural guidelines:
ii. exterior building finishes shall consist of brick, cedar, split stone concrete, or pre cast concrete materials, used either separately or in combination. Stucco or prefinished metal may be allowed at the discretion of the Development Officer, having regard for ensuring a high quality of building appearance compatible with the surrounding low density residential land uses. No painted or scored concrete block construction will be permitted on any building facade directly facing any residential area. Exterior finishing materials shall be limited to muted earth tones with strong colours limited to use as accent.
iii. building roofs shall be finished, to the satisfaction of the Development Officer, with cedar shakes, cedar siding, asphalt shingles, clay tiles, or prefinished metal unless the roof is concealed from view by other building details, such as a parapet wall, when viewed at normal eye level;
iv. all rooflines shall include elements of sloped residential character and shall be provided to the satisfaction of the Development Officer; and
i. all mechanical equipment on the roof of any building shall be completely screened or incorporated within the building roof.
j. Signs shall be allowed in this District as provided for in Schedule 79D and in accordance with the general provisions of Sections 79.1 to 79.9 inclusive of the Land Use Bylaw. In addition, free standing signs intended to identify the site and the principal tenants shall be located along the 50 Street frontage in order to protect the visual environment along 40 Avenue.
k. Development in this District shall be evaluated with respect to compliance with the general development regulations of Sections 5079 inclusive of the Land Use Bylaw. In this evaluation, the Development Officer may grant relaxations to those regulations and the provisions of this district, if, in his opinion, such a variance would be in keeping with the general purpose of this district and would not affect the amenities, use and enjoyment of the neighbouring properties.
a. A Gas Bar shall be sited not less than 30.05 m (100 ft.) from the west property line.
b. Gas Bars shall be developed in accordance with Section 82 of the Land Use Bylaw and in addition, a canopy shall be located over the gas pump islands to ensure that illumination is directed downwards and away from direct view by adjacent residential uses. Such canopy shall be designed and finished in a manner consistent with the design and finishing of the principal building.
c. Daytime Child Care Services shall be developed in accordance with Section 93 of the Land Use Bylaw and shall be located in the northern portion of the proposed development. In addition, outdoor play space shall be provided adjacent to the north portion of the building and screened with a 1.85 m (6.1 ft.) high fence. The wall adjacent to the outdoor play space shall contain windows in order to allow the observation of children.
d. Indoor Participant Recreation Services shall be limited to athletic clubs and health and fitness clubs.

Bylaw attachments
