Jackson Heights - abutting 50 Street and 44 Avenue
Bylaw 13264 (February 13, 2003)
To establish a Site Specific Development Control Provision to accommodate the development of a coffee shop with drive-through services (Speciality and Drive-In Food Services), with regulations to ensure that the development will be compatible with the surrounding low density residential development and the site’s prominent location abutting 50 Street and 44 Avenue.
This Provision shall apply to a 0.36 hectare portion of Block C, Plan 912 2397, as shown on the attached Schedule C adopting this bylaw.

a. | Site development shall be in general accordance with the site plan attached as Appendix 1. The quantity and location of landscaped islands, and general site landscaping, shown on Appendix 1 is for illustration purposes only. Landscaped islands and landscaping shall be provided in accordance with Sections 54.2.3.b and 55 of the Zoning Bylaw respectively, and the regulations listed below. |
b. | The maximum gross floor area of any individual business premise shall not exceed 500 m2. |
c. | The maximum floor area ratio shall be 0.35. |
d. | The maximum building height shall neither exceed 6.0 m nor one (1) storey. |
e. | A building setback of 10.0 m shall be provided from both 44th Avenue and 50th Street for the principal building. A minimum building setback of 3.0 m shall be provided from the north and east property lines. |
f. | A landscaped yard, a minimum of 6.0 m in width, shall be provided abutting 44th Avenue and 50th Street. |
g. | A landscaped yard is not required abutting the north and east property lines. |
h. | Signs shall comply with the regulations contained in Schedule 59D of the Zoning Bylaw. |
i. | Freestanding Signs shall be limited to placement along the western and southern frontages of the site |
j. | Fascia On-premise Signs shall be limited to the south, west and the west half of the north façade. |
